Legislature 2011 Update: AB199 & SB329 –

AB199 Background -practicing in settings outside of pharmacies and hospitals – mechanisms for prescribing under collaborative practice allowing pharmacists to act as agents of the physician in community settings.  Allowing pharmacists working under protocol to be able to call into community pharmacies.  Work with BOP developing regulations.

SB329 Background Discussion requirement in every exam room with notice that patient has a right of indication included on the prescription and pharmacist would have a requirement to place on label.  Language surrounding encouragement of Medical boards to have CE programs on medication management and why it’s important that patients know what there medications are for.  Will affect retail pharmacy practice more than hospitals.  Passed in law – posting signs in exam rooms, October 1, 2011.  Click here for pdf document for posting.

In response to drug shortages crisis, a Senate bill S. 296 “Preserving Access to Life Saving Medications Act” has been introduced. This legislation would require manufacturers to notify the FDA about manufacturing problems or when a drug is to be discontinued. The bill also requires that the FDA maintain an online list of drugs in shortage situations and revises the agency’s definition of medically necessary. H.R.2245 Preserving Access to Life-Saving Medications Act of 2011 is the companion bill to S. 296. This bill is to amend the Federal Food, Drug, and Cosmetic Act to provide the Food and Drug Administration with improved capacity to prevent drug shortages. A manufacturer of a drug shall notify the Secretary of a discontinuance or interruption in the manufacture of such drug.  Advocate to membership to write to support these bills.
